    WHEREAS, on September 17th, 1980, a certain Mortgage was executed by Valley View Apartments, Inc. a Minnesota Corporation, as Mortgagor in favor of the United States of America acting by and through the Secretary of Housing and Urban Development (Secretary), as Mortgagee, and was recorded on September 17, 1980 as Document No. 233144 in the Office of the County Recorder, Redwood County, Minnesota; and

    All parties who are interested in bidding at the sale must obtain a bid package.  The bid package contains sample copies of documents that the purchaser must deliver at the sale and copies of documents that the purchaser must execute at closing.  The bid package also describes, among other things, the procedure for prorating real estate taxes, and the purchaser's obligations after the sale.  When making their bid, all bidders except the Secretary must submit a deposit totaling $25,000 in the form of a certified check or cashier's check made out to the Secretary of HUD.  The remainder of the purchase price, together with a Letter of Credit in the amount of $26,200 must be delivered within 30 days of the sale or at such other time as the Secretary may determine for good cause shown, time being of the essence.  This amount, like the bid deposits, must be delivered
    in the form of a certified or cashier's check.  If the Secretary is the high bidder, he need not pay the bid amount in cash.  The successful bidder will pay all conveyance fees, all real estate and other taxes that are due on or after the date of closing and all other costs associated with the transfer of title.
    Before being accepted as the purchaser, the high bidder must deliver to the Commissioner, at the time of sale, an executed Acknowledgment by Bidder form.  In this form, the high bidder acknowledges that he understands the terms of the sale and the obligations to which he will be bound after the sale.
    The Secretary may grant an extension of time within which to close.  All extensions will be for 30 days, and purchaser must pay a fee, which is the greater of 1.5% of the purchase price or HUD's current holding cost.  The extension fee shall be paid in the form of a certified or cashier's check made payable to the Secretary of Housing and Urban Development.  If the high bidder closes the sale prior to the expiration of any extension period, the unused portion of the extension fee shall be applied toward the amount due at closing.
    Page 7 of 12 - If the high bidder is unable to close the sale within the required period, or within any extensions of time granted by the Secretary, the high bidder's deposit will be forfeited, and the Commissioner may offer the Project to the second highest bidder for an amount equal to the highest price offered by that bidder.  All other terms of the sale would remain the same.  If the second highest bidder rejects the Commissioner's offer, no further offers will be made and the sale will be canceled.

    AN ORDINANCE AMENDING
    REDWOOD FALLS CODE
    OF ORDINANCES
    § 11.02 AND § 11.25 PERTAINING TO BOARDING HOUSE ZONING
    THE CITY COUNCIL OF
    REDWOOD FALLS ORDAINS:
    SECTION 1.  Boarding Houses.  The use of assisted living facilities to care for adults in our community needing a heightened level of service has increased in recent years.  As a result, the Redwood Falls Code of Ordinances should be updated to reflect this need, and to provide clear guidance on the zoning and permitting of such facilities in our community.  Therefore, Redwood Falls Code of Ordinances § 11.02, subd. 20 and § 11.25, subd. 2(B) shall be amended and restated in their entirety as follows:
    11.02 DEFINITIONS
    “Subd. 20. The term "boarding house" means a licensed facility or building other than a hotel, where, for compensation and by prearrangement for definite periods, meals or lodging and meals are provided to three or more persons, not of the principal family therein, pursuant to previous arrangements and not to anyone who may apply, but not including a building providing these services for more than ten persons.”
    11.25 “R-4” , MULTIPLE-FAMILY
    RESIDENTIAL DISTRICT
    “2.  Permitted Uses. The following are permitted uses in an "R-4" District:

    SUMMARY OF ORDINANCE NO. 34, FOURTH SERIES
    AN ORDINANCE AMENDING
    REDWOOD FALLS CODE
    OF ORDINANCES § 11.65 PERTAINING TO THE FLOOD PLAIN DISTRICT
    NOTICE IS HEREBY GIVEN that, on July 2, 2013, Ordinance No. 34, Fourth Series was adopted by the City Council of the City of Redwood Falls, Minnesota.
    NOTICE IS FURTHER GIVEN that, because of the lengthy nature of Ordinance No. 34 Fourth Series, the following summary of the ordinance has been prepared and approved for publication.
    SUMMARY
    1. Ordinance No. 34, Fourth Series, amends and restates, in its entirety, existing § 11.65 and § 11.66 into a single, unified ordinance to be codified as § 11.65.  The Minnesota Department of Natural Resources, in compliance with directives from the Federal Emergency Management Agency (“FEMA”) and the National Flood Insurance Program (“NFIP”) has requested that the City of Redwood Falls adopt and incorporate the “Flood Insurance Study, Redwood County, Minnesota And Incorporated Areas,” the accompanying Flood Insurance Rate Map Panels numbered 27127C0145C, 27127C0153C, 27127C0154C, 27127C0161C and 27127C0162C, and to make other pertinent revisions to the existing floodplain ordinance to bring it into compliance with FEMA regulations, NFIP requirements and the “Statewide Standards and Criteria for Management of Floodplain Areas of Minnesota” as set out in Minnesota Statutes § 103F and Minnesota Rules 6120.5000 to 6120.6200.  The proposed changes accomplish these purposes.
    2. The proposed amendments change the definitions section of the city's zoning ordinance, adopts the city's NFIP zoning overlay maps, and the city's zoning regulations regarding the floodplain overlay districts – floodway district, flood fringe district and general flood plain district.  The updates are intended to reflect an updated study and mapping of the city's floodplain areas. The changes are being made to ensure consistency with current Federal Emergency Management Agency (FEMA) and National Floodplain Insurance Program (NFIP)
    requirements.
    3. While many of the changes are technical and non-substantive in nature, the map changes may include or exclude certain properties from the floodplain overlay district.  For those properties within the district, the changes modify FEMA required regulations that limit alterations to nonconforming existing structures that are in the floodplain, limit the placement of recreational vehicles and the construction of new structures in the floodplain, and impose additional FEMA required criteria that must be satisfied prior to issuing any variances from the development standards in the floodplain district. The amendments also require certain notifications to property owners of the impact their land use proposals may have regarding FEMA and NFIP program eligibility and costs for those owners.
